Terms of Service

The Terms of Service are subject to applicable Spanish legislation and refer to the relationship between the rental company RentalPanda.es, hereinafter referred to as RP, and the renter. The use of this offer requires explicit and unconditional acceptance of these terms of service. Any use of the RP services requires the user to agree to the terms of use as described in the Terms of Service and the Frequently Asked Questions. RP reserves the right to change these terms at any time without notice.

Product Descriptions

We will keep the descriptions of our baby, beach, or holiday products to buy or rent as accurate and correct as possible. However, RP cannot be held responsible for erroneous descriptions, or for errors in the manufacturer descriptions, nor for product changes or manufacturer changes. RP reserves the right to offer products that differ from the descriptions.

Liability

RentalPanda.es, including its employees, shareholders, agency partners, affiliate partners and owners, assumes no liability whatsoever for any damages that may arise in connection with the use of the rented products (including any court or legal costs). The renter is responsible for any damage that may result from the use of the rental items. However, the operators of Rentalpanda.es are covered by liability insurance with a sum of € 200,000 per claim. The renter is aware that there is a risk of personal injury resulting from the use (or misuse) of the rented baby, beach or holiday articles, and therefore assumes full responsibility for the proper use of the products during the rental period. Rentalpanda Baby, Beach and Holiday Equipment Rentals Majorca cannot be held liable under any circumstances for personal injury resulting from the use of rental products. In addition, the renter agrees to hold RP and its affiliates, employees, owners or partner harmless with respect to any claims arising out of losses, indemnities or legal fees from any third party which could be linked to the offer of RP. In addition, we are not responsible for damages caused by viruses, trojans, worms or other malware.

Security deposit and product condition

Ahead of each renting of products the renter needs to pay a deposit which is based on the value of the rental products. The deposit amount will be communicated to the renter upon reservation confirmation. The deposit serves to protect RentalPanda, in case the product is stolen, lost, damaged or destroyed during the rental period. In this case, if necessary, we reserve the right to withhold the deposit. The renter is responsible for confirming the proper and safe condition of the products before the start of the rental period (in practice: when handing over the products), or to communicate complaints. If the proper condition has been confirmed, the renter agrees to all terms of use as described in the Terms of Service and the Frequently Asked Questions. Should complaints be submitted after handing over, RP must assume that the complaint was not caused by RP but by the renter. Should actual product deficiencies occur during the rental period, we ask the renter to communicate this immediately, in order to replace the product with a new one if necessary. The rented baby items, beach items or holiday items must be returned at the end of the rental period by the renter in a proper condition. The deposit is then fully refunded upon return.

Product delivery at the airport

If the customer can not be reached within 1.5 hours after landing (WhatsApp, telephone, e-mail), the driver must leave the airport and the order will expire, without entitlement to a refund of any amounts already paid. However, in this case, the goods can be picked up by the customer in Coll den Rabassa on the same or the next day. If the actual arrival time occurs outside of our working hours, the driver will wait a maximum of 50 minutes after the actual landing. Our working hours are from 6:00 to 23:00.

Use by third parties

Our baby, beach and holiday items for hire may only be used by the renter and not by third parties. If the rented products are damaged by third parties, the tenant will be held responsible for this and must expect RP to keep the deposit.

Ownership of products and content

All baby equipment and beach or holiday rental products remain the property of RentalPanda Mallorca at any given time. Furthermore, any content displayed on the website RentalPanda.es, including, but not limited to, texts, graphics, photos, brands, designs, links, videos or source codes, are protected by copyright. Any reuse or misuse of the published content by third parties is prohibited. This means that no-one will copy and / or reproduce, publish, alter, or otherwise use any content of the website without imposing a criminal offense. Without prior written consent from RP any other rights are excluded.

Implementation of cookies

The user of RentalPanda.es agrees to the use of cookies to improve the web experience. Cookies simplify storing information in order to receive improved offers in the future, and make the use of the services as comfortable as possible. The user has the possibility to configure the use of cookies by means of modifying the browser settings, which, however, may have an effect on the optimal functioning of the website.

Accessibility

Our website is generally accessible 24 hours a day, seven days a week, unless it is unavailable through maintenance, renewal or force majeure. We are not responsible for any consequences that may result from any non-availability, and cannot be held responsible for this.
